PALM BEACH MEGA TAN GIFT CARD TERMS AND CONDITIONS
The Palm Beach Mega Tan Gift Card ("Gift Card") is issued by individually owned and operated participating Palm Beach Mega Tan salons. Gift cards may only be redeemed at the location at which they were purchased, the address of which is printed on the back of the card. The Gift Card may be redeemed for any products and services available at the Palm Beach Mega Tan salon that sold the Gift Card. It may not be redeemed for goods or services at any other Palm Beach Mega Tan salon, it cannot be redeemed for cash, it is not refundable or returnable, change will not be given from it and the Gift Card cannot be used to purchase another Gift Card.

To redeem the value of the Gift Card it must be presented at the time a purchase is made. The full amount of the Gift Card will be applied to reduce the transaction amount total, and if there is a remaining value at the end of a transaction, that remaining value will be added to the customers file as prepaid dollars and may be used for future purchases. A customer who does not have a file may have one created for the sole purpose of holding the bonus bucks. If a purchase exceeds the amount on the Gift Card, the cardholder is responsible for paying the difference at the time of purchase. Taxes are not charged on the purchase of a Gift Card; however, applicable taxes will be charged on the items purchased when redeeming a Gift Card.

The purchase of a Palm Beach Mega Tan Gift Card is not eligible for Bonus Bucks reward. When the Gift Card is used as a payment towards a purchase, you may earn Bonus Bucks on that purchase.

Safely protect Gift Cards and treat them like cash. Palm Beach Mega Tan is not responsible for any Gift Cards that are lost, stolen, destroyed, altered or used without the cardholder's permission. The Gift Card cannot be replaced or refunded if lost, stolen, destroyed, altered and all unauthorized usage of the Gift Card is solely the responsibility of the cardholder.

Palm Beach Mega Tan will not honour Gift Cards that are obtained by fraud or theft and reserves the right to cancel any such Gift Cards.
The Palm Beach Franchise Corporation, Franchisor of the Palm Beach Mega Tan franchise system, has no liability for redemption of gift cards.
Subject to applicable laws, Palm Beach Mega Tan Gift Cards have no predetermined expiry date and are valid until such time as the Gift Card is redeemed.

Palm Beach Mega Tan reserves the right to change the Gift Card Terms and Conditions at any time, without notice. By using the Gift Card, the holder of the Gift Card is deemed to have received notice of and have agreed to and accepted the Terms and Conditions of the Palm Beach Mega Tan Gift Card program.

Palm Beach Mega Tan, at its sole discretion, reserves the right to take any action or make any decision which in its sole opinion preserves the Palm Beach Mega Tan Gift Card program integrity. Palm Beach Mega Tan makes no warranties, express or implied, with respect to Gift Cards, including and without limitation, any express or implied warranty of merchantability or fitness for a particular purpose.

GOVERNING LAW
The Program shall be governed by the laws of Ontario and the laws of Canada applicable therein. Any disputes regarding the Program or in any way arising out of the Program, shall be submitted to the courts of Ontario whose courts shall have exclusive jurisdiction to hear such disputes.
